Booking Agreement

The below booking agreement is accepted by all clients booking concierge services from Simply Golden Solutions. This agreement protects Simply Golden Solutions and its clients.

This agreement (“Agreement”) is entered into by Simply Golden Solutions LLC, an Iowa limited liability company, and the individual booking concierge services on behalf of themselves or another (hereinafter referred to as the “Client”) to provide services for Client, and with the parties referred to as “Party” or together as “Parties”;

IN WITNESS WHEREOF, the parties hereto have caused this Agreement to be signed by duly authorized representatives at the time of booking concierge services whether the Client books concierge services on behalf of themselves or another.

RECITALS

WHEREAS, the Parties agree and understand that Simply Golden Solutions is not an employee of Client. Provider instead takes the role of an independent contractor. 

 

WHEREAS, the Parties agree that modification of this Agreement shall be in writing and signed by all Parties. 

Effective
Period

This agreement shall be effective once both parties sign and shall end at conclusion of the contracted time booked. Service bookings are held for 48 hours without a signed agreement. If agreement is not signed within 48 hours of time(s) request, Simply Golden Solutions will open the time(s) for other clients. 

Service Description

Simply Golden Solutions will provide the following concierge services for Client as described below: 

  • Completing miscellaneous household tasks including, but not limited to, light housekeeping, decluttering and organizing, meal prep, etc. as requested; and/or

  • Technology support including, but not limited to, cell phone/tablet/speaker set up/guidance/lessons, online payment systems, password setup/documentation as requested, online travel booking assistance; and/or

  • Household management systems such as vendor connections and/or management, check-ins during travel, document management, holiday decorating and/or removal/take-down; and/or

  • Running errands with or without non-emergency transportation services for the Client or the Client’s pet, transporting donations to donation locations; and/or

  • Travel arrangements for lodging, transportation, and/or itineraries recommended and/or made in conjunction with Client.

Service Charges

Concierge service charges are $75 per hour with a two-hour appointment minimum. Time is billed in 15 minute increments after the two hour minimum is met.

 

Rates increase for flexible time (more than one visit per day) or for time blocked in less than two hours.​ Quote will reflect the rate.

 

Booking will reflect the price agreed upon between Provider and Client. ​

Payment Policies

Payment under this Agreement shall be made as follows:

  • The Client will secure booking with a credit card. 

  • Simply Golden Solutions will charge the credit card at the conclusion of the booking. If booking is over $500, half of the booking fee shall be paid upon booking with the other half charged at the conclusion of the booking. 

  • Additional Client expenses may be agreed upon between the Client and Simply Golden Solutions to be paid for by Simply Golden Solutions. Such expenses are invoiced weekly to the Client for reimbursement with receipts. Client is responsible to pay expenses within 48 hours from invoice.

  • A late charge computed at a rate of one- and one-half percent (1.5%) of the outstanding balance will be charged on a monthly basis if not paid within 48 hours from invoice.

Cancellation

Booked services may be cancelled at no charge at least 24 hours in advance. Cancellations occurring less than 24 hours in advance are subject to a $75 cancellation fee. Cancellations must be completed on www.SimplyGoldenSolutions.com or by contacting Sherrie Nelson directly at 515.868.3493 at least 24 hours in advance to avoid a cancellation fee.

Amendments

This Agreement may be amended at any time by Simply Golden Solutions or the Client in the event that such amendment is necessary, provided both Parties agree. All amendments must be in writing and agreed to by both parties.

Responsibilities

​The Client agrees to be responsible for the following:

  • Provide the necessary requests to Simply Golden Solutions timely, in order for them to provide the services outlined in this Agreement.​

Simply Golden Solutions will be responsible for the following:

  • Provide services as requested for all Client regardless of race, color, national origin, gender, age, religion, disability, sexual orientation, or gender identity;

  • Comply with Federal and State Drug and Alcohol Free Workplace Standards;

  • Provide motor vehicles that meet all Iowa Department of Transportation safety inspection requirements; 

  • Ensure insurance policies are in place for the business, professional liability, and automobile(s). If such policy is required by law, minimum requirements are met.

Confidentiality

If Client requests confidentiality for any or all requested services, Client must request confidentiality in writing at time of booking to Sherrie@SimplyGoldenSolutions.com.
 

Simply Golden Solutions will keep any and all requested services confidential if Client requests such in writing. In such cases confidentiality cannot be maintained as required by court or law, Simply Golden Solutions will abide by court and/or law requirements. 

Subcontracting

Simply Golden Solutions may subcontract any of the work contemplated under this Agreement without prior written approval from the Client. Simply Golden Solutions shall be responsible for the performance of all of its subcontractors. 

Assignment

The Client cannot assign its rights or obligations under this Agreement in whole or in part without the prior written consent of the Provider.

Liabilities

Each party hereto agrees to be responsible for its own liabilities arising out of this Agreement, including fiscal responsibilities for deviations from the terms of this Agreement. Simply Golden Solutions agrees to indemnify and hold harmless the Client from any liabilities, obligations, claims, damages, in the event of Simply Golden Solutions’ negligence. The Client agrees to indemnify and hold harmless Simply Golden Solutions from any liabilities, obligations, claims, damages, in the event of Client’s negligence. 

Point of Contact

The day-to-day dealings between Provider and the Client shall be as set forth below. Unless otherwise herein specified, all written notices, amendments and official correspondence concerning this Agreement shall be made between Client and the Provider at the following addresses:

Conditional waiver

Any liability on the part of the Provider to adequately or properly perform this contract based on any of the following events or occurrences is hereby waived by the Client:

  • Adverse weather conditions that would create hazardous driving conditions;

  • Unforeseen vehicle shortage;

  • Shortages of fuels or lubricants beyond the control of the provider; and

  • War, riot, revolution, terrorism, act of God or other unforeseen circumstances whether of the class of causes herein before enumerated or not.

Applicable
law

This Agreement shall be deemed to have been executed and performed in the State of Iowa, and all questions of interpretation shall be constructed by the laws of such state. Any venue shall be Polk County, Iowa.
